1.1. These terms (hereinafter also the "Terms") constitute the basic rules for the use of the website available at laichter.house (hereinafter also the "Website"), operated by Nadační fond Laichterův dům (Laichter House Foundation Fund), with its registered office at Chopinova 1543/4, Vinohrady, 120 00 Prague 2, ID No.: 199 69 171, registered in the foundation register maintained by the Municipal Court in Prague under file no. N 2395 (hereinafter also the "Foundation Fund").
1.2. These Terms further constitute the basic rules for the creation and use of a user account (hereinafter also the "User Account"), which you may create through the Website, or which may be set up for you when establishing your membership in the literary club organized by the Foundation Fund, also known as "Lit klub" (hereinafter also the "Club").
1.3. You agree to and undertake to comply with these Terms by:

2.1. The Website is intended primarily for public communication and presentation of activities and information relating to the Foundation Fund and Laichter House located at Chopinova 1543/4, Vinohrady, 120 00 Prague 2.
2.2. You may use the Website only in compliance with these Terms and applicable legislation. You must not misuse the Website, interfere with its operation, or access it in any way other than through the interface and instructions provided by the Foundation Fund.
2.3. The Website is intended exclusively for your personal use. Any use of the Website or any part thereof or its content other than for personal use, in particular for your business purposes, further use by way of distribution, copying, further processing or modification, or making further reproductions of the Website or any part thereof, is prohibited.
2.4. Any interference with the technical or substantive nature of the Website is prohibited. Use beyond personal needs constitutes an unauthorized interference with the rights of the Operator and may simultaneously constitute an unauthorized interference with the rights of entities whose data, works and other intangible assets form part of the content of the Website.
2.5. By accessing the Website, you undertake not to use the Website in a manner that could harm the Foundation Fund, other users or third parties, and further not to distribute through the Website or otherwise using it or with reference to it any content that is contrary to legislation or good morals.
2.6. The Foundation Fund makes every effort to ensure that the content of the Website is as accurate and up-to-date as possible. Nevertheless, the completeness, accuracy and correctness of all content on the Website cannot be guaranteed. You therefore access the Website and its content at your own risk.
2.7. The Foundation Fund is entitled to restrict or interrupt the availability of the Website at any time, in particular for maintenance, updates or improvement of services, without any obligation to compensate for any potential damage.

3.2. The creation of a User Account is always subject to final approval by the Foundation Fund. The Foundation Fund reserves the right to reject any request for the creation of a User Account for any reason or without stating a reason. The Foundation Fund will inform you of the rejection of the User Account creation without undue delay by e-mail (if you provide a contact e-mail).
3.3. When creating a User Account, you are obliged to provide only truthful, accurate and up-to-date information to the extent required by the Foundation Fund. In the event of a change in the information you have provided, you are obliged to notify the Foundation Fund of such change without undue delay, e.g. through the User Account, if technically possible.
3.4. Access to the User Account is protected by login credentials (username and password) that you choose. You are obliged to keep your login credentials confidential and must not disclose them to any third party. You are not authorized to allow any third party to use your User Account. The Foundation Fund is not liable for any harm, including damage, that may arise from a breach of these obligations. You are obliged to immediately inform the Foundation Fund of any unauthorized use of or security breach of your User Account.
3.5. You may use the User Account only in compliance with these Terms and applicable legislation. You must not misuse the User Account, interfere with its operation, or access it in any way other than through the interface and instructions provided by the Foundation Fund.
3.6. By creating a User Account, you undertake not to use the User Account in a manner that could harm the Foundation Fund, other user account holders or Website users, or third parties, and further not to distribute through the User Account any content that is contrary to legislation or good morals.
3.7. The Foundation Fund is entitled to restrict or interrupt the availability of the User Account at any time, in particular for maintenance, updates or improvement of services, without any obligation to compensate for any potential damage.
3.8. You have the right to cancel your User Account at any time, with all related consequences – including that if you are also a Club member, the Foundation Fund may have the right to terminate your Club membership in accordance with the Club Terms. If you decide to do so, please send an e-mail containing a written cancellation request to the e-mail address lars@laichter.house. Your User Account will be cancelled within 10 business days from the date of delivery of your request to the Foundation Fund. You will subsequently be informed of the cancellation by e-mail.
3.9. The Foundation Fund has the right to cancel your User Account at any time for any reason or without stating a reason. In such case, your User Account will be cancelled as of the date of sending the e-mail informing you of the cancellation of your User Account by the Foundation Fund.
3.10. If you are also a Club member, the Foundation Fund may cancel your User Account only if:
In these cases, your User Account will be cancelled as of the date of sending the e-mail informing you of the cancellation of your User Account by the Foundation Fund, or as of the date of cancellation of your Club membership, whichever occurs first.
3.11. In the event of cancellation of the User Account, the Foundation Fund reserves the right to archive and retain long-term all content that was uploaded or created through the User Account, with the exception of your personal data, which will be handled in accordance with the Privacy Policy available at laichter.house/legal/privacy.
4.1. The Foundation Fund is not obliged to ensure continuous and uninterrupted availability of the Website or User Account. In the event of their unavailability or incorrect or limited functionality, the Foundation Fund is not obliged to compensate any direct, indirect, incidental, extraordinary or other damages arising in connection with the inability to use the Website or User Account.
4.2. The Foundation Fund reserves full ownership rights to all elements of the Website and User Account, including their technical design, graphic design, database structure, software and all other components of these services, regardless of any possible changes or modifications to the Website or User Account that may be made in the future.
4.3. All content of the Website and User Account, including all texts, photographs, videos, images, graphics, illustrations, diagrams, lists, sorting systems and other works, as well as the design of the Website and User Account itself, constitutes a copyrighted work of the Foundation Fund or licensed to the Foundation Fund and is protected by the exclusive copyright of the Foundation Fund, or of third parties who have granted the Foundation Fund authorization to use such content.
4.4. The Foundation Fund reserves all economic rights of the author to all such protected works. If the Website or User Account also includes content or links to materials and works protected by the intellectual property of third parties, such content of the Website or User Account remains the property of the respective third party. By using the Website or User Account, no such rights of the Foundation Fund or third parties are transferred to you.
4.5. By providing access to the Website and User Account, the Foundation Fund grants you a non-exclusive, personal, non-transferable and free license to use the content of the Website and User Account exclusively for your personal and non-commercial purposes.
4.6. If you upload any content through the Website or User Account, you grant the Foundation Fund a non-exclusive, perpetual, worldwide, royalty-free license without any restrictions to use, archive and further share, reproduce and distribute it. You also represent and warrant that you have all the rights, consents or other necessary authorizations for such use of your uploaded content and its provision to the Foundation Fund to the specified extent.
4.7. Uploading, posting or downloading any material that infringes copyrights, intellectual property rights or other rights is prohibited. The Foundation Fund reserves the right to remove such materials immediately. Uploading, posting or downloading any material that violates the publicity and privacy rights of any person, as well as any material that may be considered offensive or defamatory, as well as material whose content or upload to the Website or User Account is in any way contrary to legislation, is prohibited, and such material will be removed or modified at the Foundation Fund's discretion as soon as the Foundation Fund becomes aware of it.
4.8. Any automated downloading, copying or extracting of content from the Website or User Account (including so-called web scraping and data mining) as well as using the content of the Website or User Account for training artificial intelligence or other forms of machine learning without the prior express written consent of the Foundation Fund is strictly prohibited.
4.9. The Foundation Fund reserves the right to unilaterally block access to the Website or User Account for any user who violates these Terms or applicable legislation, even without prior notice. The Foundation Fund will inform you of such access restriction and its reason without undue delay (if available).
5.1. These Terms are binding on you from the moment you access the Website, for the entire duration of its use, and further from the moment your User Account is created.
5.2. These Terms are governed by Czech law, in particular Act No. 89/2012 Coll., the Civil Code, as amended.
5.3. These Terms apply only to the use of the Website and User Account. In the event of any conflict between these Terms and the Club Terms in relation to Club membership conditions that do not concern the User Account or Website, the Club Terms shall always prevail.
5.4. Any rights and obligations arising from your use of the Website and User Account or from these Terms may be assigned to any third party only with the prior written consent of the Foundation Fund.
5.5. These Terms may only be accepted in the wording presented by the Foundation Fund. Any acceptance of these Terms with an amendment or reservation is excluded, as is the possibility of determining the content of these Terms by reference to any other terms.
5.6. The Foundation Fund has the right to unilaterally amend these Terms at any time. The new wording of the Terms will be announced by publication on the Website. You may reject a change to the Terms:
5.7. If any provision of these Terms proves to be invalid, ineffective or unenforceable, this fact does not affect the validity, effectiveness or enforceability of the remaining provisions of these Terms. The Foundation Fund has the right to replace such provision with a provision whose content and purpose most closely approximates the original provision. The procedure and rights under Section 5.6 of these Terms shall not apply in such case.
5.8. Any disputes between you and the Foundation Fund shall be resolved by the competent court of the Czech Republic according to the registered office of the Foundation Fund.
5.9. These Terms are effective as of 1 January 2026.
