1.1. These terms (hereinafter also the "Terms") constitute the basic rules for the establishment and duration of membership (hereinafter also the "Membership") in the literary club organized by Nadační fond Laichterův dům (Laichter House Foundation Fund), with its registered office at Chopinova 1543/4, Vinohrady, 120 00 Prague 2, ID No.: 199 69 171, registered in the foundation register maintained by the Municipal Court in Prague under file no. N 2395 (hereinafter also the "Foundation Fund").
1.2. The activities of the Foundation Fund consist primarily in maintaining and making accessible Laichter House – a publishing house designed by architect Jan Kotěra for the Jan Laichter publishing house (hereinafter also the "House"), maintaining and making accessible the cultural and literary legacy of the Jan Laichter publishing house, and further developing this legacy as well as the legacy of the entire House together with its surroundings and community.
1.3. In the course of its activities, the Foundation Fund accepts from third parties, within the meaning of Section 2055 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter also the "Civil Code"), both monetary and non-monetary gifts (hereinafter also the "Gift"). In the case of a monetary Gift, the purpose of such Gift is to provide financial resources to the Foundation Fund for its activities within the meaning of Section 20(8) of Act No. 586/1992 Coll., on Income Taxes, as amended.
1.4. Each donor is free to decide how much or what they wish to donate to the Foundation Fund. However, the Foundation Fund reserves the right to refuse any Gift from any donor, regardless of whether the Foundation Fund has previously accepted the same type of gift or a gift from the same donor, without stating a reason for such refusal.
1.5. The Foundation Fund does not provide any consideration in return for accepted Gifts, regardless of their amount or nature. However, if a Gift exceeds the amount specified further in these Terms, the respective donor may, with their consent, be granted membership in the literary club of the Foundation Fund, also known as "Lit klub" (hereinafter also the "Club"), the terms of which are set out further in these Terms.
1.6. Upon request, the Foundation Fund will issue a confirmation of the Gift, which will contain at least the specification of the Foundation Fund as the recipient of the Gift, the value and subject of the Gift, the purpose for which the Gift was provided, and the date of its provision. The confirmation will be sent to the donor electronically to the e-mail address provided by the donor to the Foundation Fund for this purpose.
1.7. The Foundation Fund undertakes to use all provided Gifts in accordance with its founding deed and statutes, as well as with applicable legislation.

2.1. Club Membership may be established on the basis of providing a Gift to the Foundation Fund in one of the following ways:
Upon fulfilment of one of the above conditions, you have the right to apply for the establishment of Club membership (hereinafter the "Membership").
2.2. Membership is established from the moment the first Gift is provided and the conditions in Section 2.3 or 2.4 of these Terms are met. In the case of a regular monthly Gift, Membership is always established for a period of one (1) month and is automatically extended for another monthly period if you provide another regular monthly Gift for the following month in the minimum amount pursuant to Section 2.1 point (i) of these Terms before the expiry of the current month of the Membership period. In the case of a one-time annual Gift, Membership is always established for a period of one (1) year and is automatically extended for another annual period if you provide another regular annual Gift in the minimum amount pursuant to Section 2.1 point (ii) of these Terms before the expiry of the current year of the Membership period. If the conditions for extending Membership are not met, Membership does not terminate automatically, and the Foundation Fund is entitled to proceed in accordance with Section 2.12 point (i) of these Terms.
2.3. In the case of monetary Gifts, you may apply for Membership online through the form on the Foundation Fund's website at laichter.house/auth/club. By filling in and submitting the form, you agree to these Terms and at the same time declare that you have read the Privacy Policy. Without granting this consent and declaration, Membership cannot be established for you.
2.4. In the case of non-monetary Gifts, you may apply for Membership only through a representative of the Foundation Fund. In the case of a non-monetary Gift, you are obliged to submit to the Foundation Fund an assessment of the value of the Gift. If requested by the Foundation Fund, you are further obliged to submit documentation proving the value of the Gift as claimed by you. The final recognised value of a non-monetary Gift is always subject to the Foundation Fund's approval.
2.5. For the establishment and management of Membership, you are required to set up a User Account (hereinafter also the "User Account"), which will serve for the management of your Membership. The conditions for the establishment, duration and termination of the User Account are governed by the Terms of Use of the Website and User Account of the Laichter House Foundation Fund available at laichter.house/legal/terms.
2.6. The acceptance of the Gift by the Foundation Fund and the related establishment of Membership will always be confirmed to you electronically by e-mail. Your Membership is established upon the sending of the confirmation e-mail by the Foundation Fund. Regardless of the amount or nature of the Gift provided, the final decision on the establishment of your Membership is always entirely at the discretion of the Foundation Fund.
2.7. On the basis of Membership, you will have the opportunity to receive certain benefits from the Foundation Fund, which, however, do not constitute consideration for the Gift you have provided, and you are in no case entitled to claim these benefits as a legal right. The specific scope and form of benefits are always determined by the Foundation Fund, which also reserves the right to change, replace or terminate benefits at any time.
2.8. Benefits that you may receive as part of your Membership may include in particular:
2.9. The Foundation Fund will always inform you of current benefits and any changes by e-mail, which you will provide to the Foundation Fund for this purpose.
2.10. Membership is non-transferable and non-assignable. If you wish to provide any benefit that the Foundation Fund provides to you on the basis of your Membership for the benefit of a third party, you may do so only with the prior consent of the Foundation Fund. In the event of the death of a member, Membership terminates automatically.
2.11. You have the right to terminate your Membership at any time in writing. If you decide to do so, please send an e-mail containing a written notice of termination to the e-mail address lars@laichter.house.
2.12. The Foundation Fund has the right to terminate your Membership by written notice sent electronically to the e-mail address you have provided to the Foundation Fund, in the event that:

In the event of any termination of Membership in accordance with these Terms, Membership terminates at the moment the relevant electronic message is delivered to the e-mail address of the addressee (i.e. in the case of termination by you, to the Foundation Fund's e-mail address, and in the case of termination by the Foundation Fund, to your e-mail address).
2.14. If for any reason it is not possible to use electronic mail for the purposes of terminating Membership, other means of communication may also be used for the termination of Membership (e.g. postal service providers, data box, personal delivery).
3.1. These Terms are binding on you as a donor from the moment your Membership is established.
3.2. These Terms are governed by Czech law, in particular Act No. 89/2012 Coll., the Civil Code, as amended.
3.3. Any rights and obligations arising from your Membership or from these Terms may be assigned to any third party only with the prior written consent of the Foundation Fund.
3.4. These Terms may only be accepted in the wording presented by the Foundation Fund. Any acceptance of these Terms with an amendment or reservation is excluded, as is the possibility of determining the content of these Terms by reference to any other terms.
3.5. The Foundation Fund has the right to unilaterally amend these Terms at any time. The new wording of the Terms will be announced by publication on the Foundation Fund's website. You may reject a change to the Terms and terminate your Membership by written notice delivered to the e-mail address lars@laichter.house within thirty (30) days of publication of the new wording of the Terms. Your Membership will in such case terminate on the date of delivery of your e-mail message to the Foundation Fund.
3.6. If any provision of these Terms proves to be invalid, ineffective or unenforceable, this fact does not affect the validity, effectiveness or enforceability of the remaining provisions of these Terms. The Foundation Fund has the right to replace such provision with a provision whose content and purpose most closely approximates the original provision. The procedure and rights under Section 3.5 of these Terms shall not apply in such case.
3.7. Any disputes between you and the Foundation Fund shall be resolved by the competent court of the Czech Republic according to the registered office of the Foundation Fund.
3.8. These Terms are effective as of 1 January 2026.
