CONSENT TO THE TAKING AND USE OF PHOTOGRAPHS AND RECORDINGS

By granting this consent, You as a natural person (hereinafter also “You”) expressly agree that Nadační fond Laichterův dům (Laichter House Foundation Fund), with its registered office at Chopinova 1543/4, Vinohrady, 120 00 Prague 2, ID No.: 19969171, registered in the foundation register maintained by the Municipal Court in Prague under file no. N 2395 (hereinafter also the “Controller”), as the personal data controller, may do the following:

at the event “[event name / description]” held on [date] in the premises of the house at Chopinova 1543/4, Vinohrady, 120 00 Prague 2 (hereinafter also the “House”):

• take photographs and audio, visual or audiovisual recordings (video recordings) of You (hereinafter also the “Recordings”),
• retain, process, use and make the Recordings available in printed or digital form for documentary, presentation or promotional purposes, in particular for use in promotional, informational or presentation materials, publication on the websites and social networks of the Controller or the House, or disclosure to third parties where necessary to obtain or draw down a subsidy, grant or other similar support or to demonstrate compliance with its conditions.

The Recordings may also capture and process all Your personal data and expressions of Your personal nature captured in the Recordings made.

This consent is granted in accordance with:

• Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter also the “GDPR”),
• Sections 84, 85 et seq. of Act No. 89/2012 Coll., the Civil Code, as amended.

Granting this consent is the legal basis for processing Your personal data to the extent specified in this consent. You have the right to withdraw this consent at any time by sending an e-mail to the Controller’s contact address at dobry.den@laichter.house.

Granting this consent is not a condition for participating in any event held in the House, including the event specified in the introduction to this consent. If You decide not to grant this consent or withdraw it at any time, this will not affect Your right to participate in the relevant event held in the House, provided that You meet the other prerequisites and requirements for Your participation (e.g. purchasing a ticket).

This consent does not apply to photographs and video recordings taken by the Controller on a one-off basis for the purpose of capturing the course and atmosphere of individual events held in the House and providing information about these events and the Controller’s activities. These photographs and video recordings are not primarily intended to capture or identify individual persons, but to capture the House, its premises and the course of the relevant event. The Controller does not take these photographs and video recordings for the purpose of systematically monitoring persons or maintaining records of persons. In these cases, the Controller therefore does not process personal data within the meaning of Article 2 GDPR, and the photographs or video recordings, their taking and further processing are not subject to this consent.

At the same time, You agree that the person making the Recordings is entitled to grant the Controller a license to the Recordings as their copyrighted works (if the Controller itself is not the person making the Recordings). You also agree that the Recordings may be changed, edited, used as part of a collective work, or that only parts of them may be used, to the extent necessary for the purposes stated in this consent.

You also declare that, together with this consent, You have read the Privacy Policy issued by the Controller, which describes in greater detail Your other rights in relation to the processing of Your personal data on the basis of this consent and is available at https://laichter.house/en/legal/privacy.
